Bhatts sued for lifting lyrics

Film actress and producer Pooja Bhatt, lyricist Nida Fazli and director Mahesh Bhatt have been sued for using a poem originally written by Makhdoom Mohiuddin, in their 1997 feature film, Tamanna
According to the eldest son of late Makhdoom Mohiuddin, Nusrat Mohiuddin, the poem Intezar , written by his father in the 1940s was used in the film as the song Shabke Jage Hue . It was credited to the movies lyricist Nida Fazli.

Addressing a press conference, organised by the All India Progressive Writers Association (AIPWA), AP chapter, on Thursday, Nusrat said that he had approached the Bhatts and Nida Fazli in 1998 pointing to them that the song was his fathers creation and that the credit should go to the original lyricist.

When he received no response from the parties in question, Nusrat served a legal notice in November the same year. In spite of my repeated attempts to make them realise and rectify their mistake, I had no breakthrough. Nusrat said.

In August 2003, he filed a case in the city civil court, Hyderabad, against Nida Fazli, Mahesh Bhatt and Pooja Bhatts production house demanding rectification of the credits in the film Tamanna and Rs 10 lakh as compensation.

Makhdoom Mohiuddin was a Marxist who pioneered the progressive writers movement. He had played a major role in the Telangana Armed Struggle against the Nizams rule as the leader of the Communist Party in the state.

He was elected to the Legislative Council in 1956 and went on to become the opposition leader of the AP Legislative Council, a post he held until his death in 1969.

A poet since his school days, Makhdoom released his first poetry collection Sukh Savera in 1994, which contained the poem in question - Intezar .

Many of my fathers poems have been used by filmmakers, but with due acknowledgement and permission of royalty holders, Nusrat said.
